2. Services

The Bamboo Lab provides digital marketing and technology services including:

  • Website and web application development
  • E-commerce solutions
  • Mobile application development
  • Strategic consulting and optimization

3. Service Engagement

All services are provided subject to a signed agreement or statement of work. Services include:

  • Scope of work will be defined in project-specific agreements
  • Timelines and deliverables are subject to mutual agreement
  • Payment terms will be specified in individual contracts
  • Changes to scope may require additional fees and timeline adjustments

4. Client Responsibilities

Clients agree to:

  • Provide timely access to necessary accounts, platforms, and information
  • Provide accurate and complete information required for services
  • Respond to requests for feedback and approvals in a timely manner
  • Ensure they have rights to any content, materials, or assets provided
  • Comply with all applicable laws and platform policies

5. Intellectual Property

Upon full payment, clients receive ownership of deliverables created specifically for them. However:

  • The Bamboo Lab retains rights to proprietary methodologies, tools, and frameworks
  • Pre-existing intellectual property remains with The Bamboo Lab
  • Third-party components are subject to their respective licenses
  • The Bamboo Lab may showcase work in portfolios unless otherwise agreed

6. Payment Terms

Payment terms will be specified in individual contracts. Generally:

  • Invoices are due within specified payment terms
  • Late payments may incur fees and service suspension
  • Refunds are subject to the terms of individual agreements
  • All fees are exclusive of applicable taxes

7. Performance and Results

While The Bamboo Lab strives for optimal results, we cannot guarantee specific outcomes such as search engine rankings, ad performance, conversion rates, or revenue increases. Results depend on multiple factors including market conditions, competition, and client collaboration.

8. Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the engagement. This includes business strategies, technical implementations, and sensitive data.

9. Limitation of Liability

The Bamboo Lab shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid for services in the preceding 12 months.

10. Termination

Either party may terminate services subject to the terms of individual agreements. Upon termination:

  • Client remains responsible for payment of services rendered
  • Access to tools and platforms may be discontinued
  • Deliverables completed to date will be provided upon full payment
  • Confidentiality obligations continue beyond termination

11. Third-Party Services

Our services may integrate with third-party platforms (Google Ads, Meta, Shopify, etc.). These are subject to their respective terms of service. The Bamboo Lab is not responsible for changes to third-party platforms or policies.

12. Modifications

The Bamboo Lab reserves the right to modify these terms at any time. Continued use of services constitutes acceptance of modified terms. Material changes will be communicated to active clients.

13. Governing Law

These terms are governed by applicable laws. Any disputes will be resolved through negotiation or, if necessary, through appropriate legal channels.
